Terms of service

  • By commissioning the Artist, the Client confirms that they are 18 and above or have a legal parent or guardian to agree to all of the terms of service as listed below.
  • Clients are granted exclusive rights for personal use of the Work produced as agreed upon, which should not be transferred to any other parties.
  • Unless specified in the commission information or otherwise discussed and agreed upon, reselling rights are not included.
  • Any Work done or made available to the Client shall not be used for Artificial Intelligence, Machine Learning and NFTs.
  • Clients agree to provide all required art, references, information and assets before and during the process of the work.
  • Clients may not claim the Work as made by them or anyone else's and must credit the Artist on social platforms using the name: @monoco55

Process & communication

  • Changes may be requested for free early into the drafting process, but a fee must be paid for changes that require a lot of work late into the process (e.g. changing big sections of the pose while in lineart or coloring stage).
  • The Client is free to give feedback, but must provide the necessary references to aid in revisions.
  • Updates will be given regularly throughout the process every week, averaging from 1 to 5 times depending on the project deadline and workload.
  • Any delay on updates must be informed to the Client promptly.

Payment

  • The Artist is required to proceed on the commissioning process after 50% of the budget in USD via Paypal, Stripe or Wise invoicing is paid.
  • The Client is required to pay the remainder of the budget before the final work file in PSD and PNG is sent.

Cancellation & refunds

  • Charge-backs are not permitted and refunds should follow the terms listed below.
  • If the Artist is unable to complete the illustration by the deadline, the Client can choose to discuss a refund based on the amount of work completed.
  • The Artist retains the right to stop working with and refund clients who are disrespectful, harassing the Artist or are unclear and do not provide necessary details for proceeding with the commission process as requested.

Confidential information

  • Both the Artist and the Client shall not publicly distribute any personal information shared, including but not limited to, the legal name, address, email, phone number or date of birth without prior written consent by both parties.
  • The Artist shall not publicly disclose strictly confidential information of the Work if requested by the Client, including but not limited to, the project name, references, sketches and completed illustration until prior written consent by the Client.
  • Otherwise, both parties have the right to request payment of any losses, damages, claims, liabilities, costs and expenses from disclosure of any personal and confidential information.
